The Luxembourg Court of Appeal confirmed this month the Court ruling which stated that the City of Luxembourg is in no way empowered to prohibit the presence within its walls with a circus menagerie. This decision, which invalidates the refusal of the City Council to host the biggest circus in Europe, now makes it possible for Luxembourg to reconnect with the circus classical and relive the joys and emotions closer to its animals.
The ban was enacted in 2009 when the City of Luxembourg had not allowed the German circus Krone occur "on the basis of considerations relating to animal welfare." Circus Krone had decided to attack this decision in court, arguing it was contrary to Luxembourg law and violated freedom of movement and provide services guaranteed by the European Community.
On 29 September 2010, the Administrative Court had disposed that local authorities were not empowered to adjudicate on matters governed by national law.
